Bissesar Business Email Terms of Use

These Terms are governed by and construed in accordance with the laws of New Zealand. You irrevocably submit to the exclusive jurisdiction of the courts of New Zealand for any disputes arising out of or in connection with these Terms or the use of the Service.

1. Governance and Jurisdiction

By accessing or using our Business Email Service (the “Service”), you agree to be bound by the following Terms of Use. If you do not agree to these terms, you must not use the Service.

These terms apply in addition to any specific or individual agreements for managed email hosting and related business email products.

2. Service Description and Provision

Bissesar Technologies Limited provides business-grade email hosting utilising specialised and custom email software, including the SOGo Groupware webmail interface.

  • Access Protocols: Standard access is provided via IMAP (for receiving) and SMTP (for sending) emails.
  • Support Boundaries: Our support staff are responsible solely for the maintenance of the server-side infrastructure. We provide general guidance and specific configuration details (e.g., server hostnames, ports, encryption standards). We are not responsible for the configuration, troubleshooting, compatibility, or maintenance of third-party email clients (such as Microsoft Outlook, Mozilla Thunderbird, Apple Mail, or mobile apps) on user devices.

3. Limitation of Liability and Indemnity

To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act 1993, where applicable):

  • No Liability for Losses: Bissesar Technologies Limited, its directors, and employees shall not be liable for any direct, indirect, incidental, special, or consequential losses or damages. This includes, but is not limited to, loss of profits, data, goodwill, or business interruption, regardless of the cause (negligence, contract breach, or otherwise).
  • “As Is” Basis: The Service is provided on an “as is” basis and “as available” basis without warranties of any kind.
  • Indemnity: You agree to indemnify Bissesar Technologies Limited against any claims, costs, or damages resulting from your breach of these Terms or your use of the Service.

4. Data Backup and Responsibility

While Bissesar Technologies Limited performs regular server-side backups for disaster recovery purposes, these are for internal use and do not constitute a guaranteed archival service for the user.

  • User Responsibility: It is the sole responsibility of the Service user to maintain local backup copies of all emails, attachments, and contacts.
  • No Guarantee of Restoration: We cannot guarantee the safe or complete restoration of any or all emails should data loss occur. Bissesar Technologies Limited accepts no liability for data lost due to hardware failure, software corruption, or account compromise.

5. Acceptable Use and Prohibited Content

Your use of the Service is subject to strict compliance with our Acceptable Use Policy. You may not use the Service to:

  • Transmit “Spam,” bulk unsolicited messages, or chain letters.
  • Distribute malware, viruses, or any other destructive code.
  • Engage in “phishing” or any activity designed to harvest credentials fraudulently.
  • Harass, abuse, or threaten individuals or entities.

5.1 Content Scanning

To ensure the security of our network and compliance with these Terms, Bissesar Technologies Limited will scan the contents of all incoming and outgoing emails, including attachments. This automated scanning is performed to identify viruses, spam, and violations of our policies.

No copies of your content or the personal information of the email participants will be recorded except where prohibited content is found during a scan.

5.2 Illegal Material and Law Enforcement

Bissesar Technologies Limited maintains a zero-tolerance policy regarding illegal content.

  • Prohibited Material: The transmission or storage or illegal materials, including but not limited to Child Sexual Abuse Material (CSAM), is strictly prohibited.
  • Reporting: If such material is identified, the account will be immediately suspended without notice.
  • Cooperation: We will cooperate fully with New Zealand and international law enforcement agencies, including providing account data and contents when legally required or when serious criminal activity is suspected.

6. Fair Use and Hard Limits

To ensure optimal performance for all users, the Service is subject to a Fair Use Policy.

  • Resource Constraints: We reserve the right to impose “hard limits” on mailbox size, hourly/daily sending volumes, and attachment sizes.
  • Action on Excess: If your usage significantly exceeds the average usage of other customers or impacts server stability, we reserve the right to throttle, suspend, or require an upgrade to your service level, including suspending the Service until such an upgrade is purchased.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is your responsibility. We strongly recommend the use of complex passwords and regular password rotations.

8. Termination

Bissesar Technologies Limited reserves the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and all data stored on our servers may be permanently deleted.
